When the letting agent/landlord has sent the undisputed deposit into TDS.
In line with the Housing Act 2004 we act as stakeholder of these funds and can only release the deposit held in line with an agreement, adjudication decision or court order.
We do advise our member to release the undisputed balance to the tenant with the permission of the landlord. However, we cannot force them to do so.
TDS is unable to facilitate multiple outcomes for one case. Therefore, when the undisputed amount has been sent into us and you have chosen adjudication, we cannot release the undisputed amount until the final decision has been issued.
